These Terms of Use apply to the products, services, and technologies (collectively referred to as the “Products”) provided to you by Picture + Space under an ongoing agreement. These terms are intended to protect us, you as a customer, and the wider internet community from unethical, irresponsible, and illegal activities.

If you engage in activities prohibited by these terms of use, you may face service suspension and account termination. In extreme cases, we may be legally required to report you to the competent authorities.

Fair Use

We provide our facilities on the assumption that your use will be "business as usual", as described in our offer. If your use is considered excessive, additional charges may apply or capacity may be limited.

We oppose all forms of abuse, discrimination, violation of rights and/or any action that harms or disadvantages a group, person or resource. We expect you and, where applicable, your users ("end users") to use our Products with the same intent.

Customer Responsibility

We consider you, the customer, responsible for your own actions and for the actions of anyone using our Products with your permission. This responsibility also applies to anyone using our Products without permission as a result of your failure to take reasonable security measures.

By using our Products, you agree to ensure that anyone using the products and services as your end-user complies with these terms of use. Complaints about your actions or those of your end-users will be forwarded to the contact person associated with your account.

If you – or your end-user, or anyone using our Products as a result of your actions – violate these Terms of Service, we reserve the right to terminate, without prior notice, any products and services associated with your account or your account itself, or to take any corrective or preventative action we deem appropriate. To the extent permitted by law, no compensation will be provided for service interruptions resulting from a violation of these Terms of Service.

Prohibited Activities

Copyright Infringement and Unauthorized Material

Our Products may not be used to transmit, distribute, or store material that violates applicable law. This includes, but is not limited to:

1. material that is protected by copyright, trademark, trade secret, or other intellectual property rights and is used without proper authorisation; and
2. material that is obscene or defamatory, constitutes an unlawful threat, or violates export laws.

As a customer, you are solely responsible for all material that you input, upload, distribute, transmit, create, or publish through our Products, and for obtaining any necessary permissions to use any works included in such material.

Spam and Unauthorized Messaging

Our Products may not be used to send unsolicited bulk or commercial messages in violation of any laws or regulations applicable in your jurisdiction ("spam"). This includes, but is not limited to:

• sending spam;
• soliciting customers through spam sent by other service providers; and
• collecting responses to spam sent by other service providers.

Our Products may not be used to manage unconfirmed mailing lists or phone number lists (“messaging lists”). This includes, but is not limited to:

• enrolling email addresses or phone numbers on a messaging list without the permission of the owner of the email address or phone number; and
• storing email addresses or phone numbers enrolled in this manner.

All messaging lists run or hosted through our Products must be “confirmed opt‑in”. Proof of the express consent of the owner of the email address or phone number must be available for as long as the messaging list exists.

We prohibit the use of third-party purchased email lists, phone number lists, or databases intended for spam or unconfirmed messaging lists on our Products.

This policy regarding spam and unauthorised messaging activity applies to messages sent via our Products, as well as messages sent via any other network by you or a person on your behalf that directly or indirectly refer to a site hosted via our Products.

Unethical, exploitative and malicious activities

Our Products must not be used to advertise, transmit or otherwise make available software, programmes, products or services designed to violate these terms of use or the policies of other service providers. This includes, but is not limited to, facilitating means to send spam and initiating network sniffing, pinging, packet spoofing, flooding, mail-bombing and denial-of-service attacks.

Our Products may not be used to access an account or electronic resource that you do not own or have permission to access (e.g., “hacking”, “cracking”, “phreaking”, etc.).

Our Products may not be used to intentionally or recklessly introduce viruses or malicious code into Our Products and systems.

Our Products may also not be used to knowingly engage in activities intended to intimidate or harass another group or individual. Our definition of harassment includes, but is not limited to, denial-of-service attacks, hate speech, inciting racial or ethnic intolerance, and any activity intended to threaten, abuse, infringe upon the rights of, or discriminate against a group or individual.

Other activities that we consider unethical, exploitative, or malicious include:

1. obtaining (or attempting to obtain) services from us with the intention not to pay;
2. using our facilities to obtain (or attempt to obtain) services from another provider with the intention not to pay;
3. unauthorised access to, modification or destruction (or an attempt thereof) of information regarding our customers or end-users, by any means or method whatsoever;
4. using our facilities to disrupt the use of our facilities and network by other customers or authorised persons;
5. publishing or transmitting content or links that incite violence, depict an act of violence, depict child pornography, or threaten the health or safety of individuals;
6. any act or omission in breach of consumer protection legislation; and
7. any violation of someone's privacy.

Our Products may not be used by any person or entity involved in, or suspected of involvement in, activities or purposes connected with illegal gambling; terrorism; drug trafficking; arms trading; or the proliferation, development, design, production, manufacture, storage or use of nuclear, chemical or biological weapons, weapons of mass destruction or missiles, including any form of cooperation with others who support such activities or purposes.

Unauthorised use of Picture + Space property

We prohibit you from impersonating Picture + Space, suggesting that you have a significant business relationship with Picture + Space, or claiming property of Picture + Space (including our Products and our brand) for the purpose of fraudulently acquiring services, customers, patronage or user trust.

About these Terms of Use

These terms of use contain a non-exhaustive list of activities and intentions that we consider unacceptable and incompatible with our brand.

We reserve the right to modify these terms of use at any time by publishing the revised version on our website. The revised version becomes effective at the earliest of the following times:

• the date on which you use our Products after we have published the revised version on our website; or
• 30 days after we have published the revised version on our website.
